CONTRIBUTIONS TO "SELF SUING" LITIGATION - NOT A VALID ASSOCIATION EXPENSE

I am of course concerned about the recent solicitation of legal fees for the Solomon & Karpf requested class action and so I asked our attorney about the legality of Building Associations giving money to support this lawsuit. It was his opinion that the Class Action lawsuit names only unit owners as members of the class. 
 
 Building Associations are not named parties and are not named members of the class and thus have no economic interest in the class action.  A Building Association has no authority to expend Association funds on a lawsuit that does not involve the Association.  In other words the Solomon and Karpf class action legal expenses have nothing to do with the Associations and these expenses would not be a valid common expense to the Building. 
 
Now, the question arises; do you really want to sue yourselves? Please ignore this disruptive distraction, and let's get on with the real business of our Village.

"We have to believe it. At the Delegates Meeting on Friday, May 2, 2014, reports were made by UCO  Vice Presidents, as follows: V.P. Dom — changing light bulbs in the village and possibly to close Borden Crossover never mentioning what is happening with the downed fence before gate. V.P. Marcia — quadrant V.P. for above section; never mentioning fence. V.P. Joy — Working two jobs, she thanks Bob Marshall for helping. Little does she realize that she is taking a shopping day away from him @ Costco. V.P. Bob — Nothing to report, not even the fence.Where is our CAM that we pay over $70,000 yearly about this situation with the fence?Security (what Security?) — people lock your cars and Condos to protect yourself.There is a new Club in town called NAS that stands for “Neighbor  Against Stupidity”.

Johnny, maybe the whole thing about the fence just doesn't get through. Here you are complaining that it wasn't mentioned, but the fence was fixed withing days of the meeting. Did it ever cross your mind that maybe, just maybe, it was already in the works?
C'mon John, here you are complaining about Joy working two jobs and Bob going to Costco and paying our CAM $70k a year and Dom talking about lightbulbs and closing Borden crossover.
First let me point out, the CAM makes over 70K a year and we are lucky to get him so cheap. That job is easily a 125k per yr job. He took a huge paycut to come to CV. We got off easy there. We should be thankful that he is here.
Joy working two jobs? Yep, and doing them both pretty well. She does a hell of a lot more than just getting the transponder lane closed at night or getting a pothole filled.
Dom and the lights, well there is a need for brighter lights in some areas and switching to LED lights fulfills that need and the operating cost will offset the cost to change over in time.
As far as Bob going to Costco, well I am sure that what he shops for is no business of yours. Are you jealous that he can go?
Ya'know John, there is a reason that you are an EX-VP. You can't base your whole re-election campaign on just closing the lane and filling a pothole... and bouncing back and forth between the two sides didn't help you very much either..
New club in town? Before you go criticizing these officers, remember one thing...They have accomplished more in five months than you had in a year. As a matter of fact, I can't think of anything you did but close the transponder lane and fill a pothole by the Camden Pool. Please John, if you don't have anything intelligent to say, don't say anything... you may wind up as the poster boy for your own club.

Last thought on the subject: John, if you are prepared to dish it out, be prepared to take it.

From Dumb

I will not stoop to call Olga any names as she does although there are a few that would certainly fit. UCO is an organization that all the Associations are part of. Yes, we would be suing ourselves and would probably lose. These people who love to sue should get a life. There is a lot of good that can be done in the Village if energies are redirected to positive instead of negative actions as Olga and company have been doing. If an insurance pays out money, they have ways to get it back in full and more. Higher rates or cancellation. If Olga is so hard up for money, may I suggest that she get a job not go after money on the backs of neighbors and friends.

WHY SUING OVER THE ROADS MAKES NO SENSE


I am not an attorney, but I cannot imagine the suit about the roads being successful. First of all, I think that in order to successfully sue you must prove there has been negligence—maybe even gross negligence—on the part of the defendants, UCO and Dave Israel. Considering the steps that were taken before actually engaging M & M Construction Company, I doubt negligence could be proven. Moreover, the completed work was examined by an agency specializing in this and found to meet standards for such work.

Furthermore, two things were known going into the project:
(1) That (as Grace points out) in order to save money the old pavement, except in a few places, was not first being removed; therefore, cracks would reappear in time. In fact, you find this all the time when roads are repaved.
(2) That, as Dom Guarnagia pointed out in a Reporter article a few months ago, because most of our roads do not drain through storm drains, more flooded areas would result.

These facts were known. The only way to have avoided them would have been to install storm drains throughout the Village and removed all the old asphalt. The costs for both would have been astronomical.

Finally, who is being sued? Dave Israel and UCO. But who or what is UCO? The UCO board of directors is the delegates—who represent us, the owners in the associations. Despite their protests, it looks mighty like those bringing the suit are asking us to sue ourselves, to me!

IF the suit were to be successful—which, given the foregoing strikes me as an awfully big “if”—we are told all will be well because an insurance company will be footing the bill. Would this be M & M’s insurance company, with M & M facing higher insurance rates for the next several years? No, because M & M isn’t being sued. Footing the bill will be UCO’s insurance company; that is, OUR OWN insurance company!

What a clever ploy! In effect to sue oneself! Do we really think, if by some stretch the suit were successful, our insurance company would roll over and submit to this without there being the severest of repercussions? Of course not. Insurance companies are not fools. We will end up altogether priced out of the insurance market by this insurance agency or any other, in my opinion. Our buildings, which include your and my homes, will be UNINSURABLE for all intents and purposes. Think about this as we face the hurricane season!

Of course those bringing the suit want your dollars to help pay the attorneys’ fees. I can think of few worse ways to invest my money, however. I wouldn’t be helping myself, and I could be bringing irreparable harm to the Village.

The Roads

I read Olga's rant on the roads. If you listen to her and contribute to the law suit, you are suing yourselves. We are UCO. I was at the meeting for the roads way back when. The man from the paving  company told us if we did not go down to bedrock the cracks that were on the old roadway would come back. The cost to go to bedrock was considerably more than paving over the cracks. The delegates voted to pave over the existing roadway, cracks and all. We got what we paid for and the cracks came back. I guess Olga was not at that meeting or she forgets what we were told. I have a good memory. Don't contribute to the fund to sue yourself.

BY THE PRESIDENT OF THE UNITED STATES OF AMERICA
A PROCLAMATION
In every generation, there are men and women who stand apart. They put on the uniform and put their lives on the line so the rest of us might live in a safer, freer, more just world. They defend us in times of peace, times of war, and times of crisis, both natural and man-made. On Armed Forces Day, we honor the Soldiers, Sailors, Airmen, Marines, and Coast Guardsmen who render the highest service any American can offer.
The patriots who stand sentry for our security are a proud link in an unbroken chain that stretches through the centuries. This generation has distinguished itself on mission after mission, tour after tour. Because of their heroism, the core of al-Qaeda is severely degraded and our homeland is more secure. Thanks to their extraordinary sacrifice, we are winding down more than a decade of war and strengthening alliances that extend our values. These are the gifts they have given us, and this is why we owe them a profound debt of gratitude.
It is our obligation to ensure our troops have all they need to complete their missions abroad, but we must also support them when they return home. We must care for the families who serve alongside them and fulfill our promises today, tomorrow, and forever. And we must demonstrate our thanks by building a Nation worthy of their sacrifices, a Nation that lives up to our founding ideals and allows every citizen to write their chapter of the American story.
NOW, THEREFORE, I, BARACK OBAMA, President of the United States of America, and Commander in Chief of the Armed Forces of the United States, continuing the precedent of my predecessors in office, do hereby proclaim the third Saturday of each May as Armed Forces Day.
I direct the Secretary of Defense on behalf of the Army, Navy, Air Force, and Marine Corps, and the Secretary of Homeland Security on behalf of the Coast Guard, to plan for appropriate observances each year, with the Secretary of Defense responsible for encouraging the participation and cooperation of civil authorities and private citizens.
I invite the Governors of the States, the Commonwealth of Puerto Rico, and other areas subject to the jurisdiction of the United States, to provide for the observance of Armed Forces Day within their jurisdiction each year in an appropriate manner designed to increase public understanding and appreciation of the Armed Forces of the United States. I also invite veterans, civic leaders, and organizations to join in the observance of Armed Forces Day.
Finally, I call upon all Americans to display the flag of the United States at their homes on Armed Forces Day, and I urge citizens to learn more about military service by attending and participating in the local observances of the day. I also encourage Americans to volunteer at organizations that provide support to our troops and their families.
Proclamation 8984 of May 17, 2013, is hereby superseded.

Wow, that was racist!

I usually try not to comment on what I read on the Lunatic Blog. Bad enough that I read it- no need to spread the venom unneccessarily.

Today was different. First, an essay on the resurgence of anti-semitism in Europe, followed by a crazed screed that described a Francophone Canadian Homeowner as a "frenchman" and "a member of a class who has a reputation for being parsimonious".

Pure, unrestrained racism. From a person who seems to revel in vulgarity, base scatological language and now, bigotry.

I know this person who was so unfairly and publically abused. He is kind, generous to a fault, and quite literally, a humanitarian. I cannot think of a person less deserving of this type of treatment.

If there is one place on Earth where this type of discourse will not be tolerated, it is Century Village. I am confident that my neighbors will not allow this awful behavior to stand. The person who published this trash must be made to understand that there is no place for bigotry here, and those that espouse such ideas forfeit their right to participate in our public life.

Freedom of speech has limits.

A FEW WORDS ON FREE SPEECH

There is NO free speech

While members of ‘’Le Cercle des Bons Amis’’ have kept a low profile before the March elections in Century Village, a point has been reached when silence becomes immoral. A few residents might be tempted to say that Canadian snowbirds are visitors to the USA and therefore have no right to speak on CV matters. May I remind them that most of us are full-time owners of condos, full-time payers of taxes and fees even if we reside only five months a year in our wonderful village.
We were confident that after the elections, the vicious storms of words and accusations that were unleashed against people and institutions in CV would die down. Unfortunately Olga Wolkenstein has chosen this time, with the tacit approval of her small group, to take a shot below the bow and use profanity towards a democratically elected member of our community. 
There is a cost associated with the use of profanity and vicious insults. For most  people, our reputation is worth more than the money we have in the bank. Mean insults can destroy a reputation just as quickly as a stock market crash. The incendiary words recently used by Mrs Wolkenstein have that effect on the image she projects of herself. That’s why speech is not always free. In addition, people with decades of involvement in the education of our children, allowing defamatory words to be used on their blog are guilty by association. Those same people are probably scandalize at the bullying going on in our schools today !
I have listened to Mrs Wolkenstein threatening the audience in the CV theatre with an accusing index finger pointed at people. I could not help but to see her three bottom fingers pointing at herself.
Democratic institutions are to be respected. When people are democratically elected to serve in theses institutions they also should be respected. And when a dedicated person such has Mrs Joy Vestal who serves us all so well is attack, it is the whole community that is attacked. Even as she faces health chalenges, she chooses to continue to serve. She deserves our outmost respect and admiration.

BLACK MASS

Rumor has it ,there will be a Black Mass on Stoner Island  this evening. It is my understanding CV has a plethora of Devil Worshipers planning to attend and I'm hoping someone on the Blog or UCO could fill CVers in on the particulars of this inaugural event. Might this be a spin off of the Harvard event or has  BAAL finally taken control of UCO and is now residing in UCO's inter sanctum, directing CVer lives from the moist underbelly of the BEAST?

LANGUAGE


The demeaning, utterly contemptible and vile language used the other day at the Reporter office against Joy Vestal was unconscionable. No one should have to be subject to that on the part of a grown woman who should know better. Worse yet, the offender offers no apology for using such language, but instead goes on the other blog and is almost self-congratulatory about it. Her attitude is “smirking” for what she got away with. Worse still, this woman’s friend, a recent candidate for election to a high UCO office, defends her conduct!

What does this say for both women? Do we want these kind of people in office or on committees and boards?

Joy Vestal does not deserve this. May you have a Happy Mother’s Day, Joy. There are some of us who appreciate you for yourself and all you have done for this Village. May the thought of this fill your heart this day and not what you were subjected to at the office the other day.

VARIOUS PASSES
There are many types of passes issued to visitors, renters, live ins, co-owners, and others occupying apartments... gate passes from UCO, ID passes from WPRF, living here companion passes, health aide living in companion passes and many more types.
 
 It would be advantageous to have a list of all of the passes issued whether by UCO or WPRF and what documents are needed to obtain them. How about printing a list of what is needed and for how long the pass would be applicable?
 
Have an article and a list of all passes published in the REPORTER or publish it here so that when we are asked about passes, we know what to answer the questioneer correctly. We won't have to say "go to UCO or WPRF and ask them."

Trust me... I'm doing it for you...

SOLICITATIONS TO FIX ROADS ARE ACTUALLY MONEY BEGS TO ENABLE A FRIVOLOUS LAW SUIT.

Malcontents  are soliciting your money to fund a law suit against UCO and the UCO President.

This law suit is a law suit against ourselves.

How can this be? Simple; because all unit owners are members of UCO, so for a few Malcontents to sue UCO is literally suing themselves, absolutely ludicrous, and frivolous.

This law suit is a reflection of their frustration over failing in their attempt to recall the President, and then failing miserably in the March election.
-
Please do not be seduced by fantasies of riches flowing from Insurance companies, this is not a source of free money.
-
As for the roads, we have a professional engineering firms series of tests stating that we meet or exceed standards in every sample.
-
UCO is collecting prudent reserves to pave the roads in due course when they actually require repaving.

So, please do not let the Malcontents lead you over the cliff of frivolous litigation.

Just say no when they ask you to write checks; only the lawyers will get rich!!!

LAWYERS AND LAWSUITS AND MALCONTENTS - OH MY!!!

The recent meetings of the Malcontent Club have featured an Attorney presentation regarding suing ourselves for millions of dollars, over the paving project. They want a $10,000.00 retainer, plus $20,000.00 more for "expert testimony". The numbers get bigger and who is supposed to pay, you & i!
-
Pictures have been displayed, that prove that when it rains, some puddles appear which dry up in a day. Also there are some cracks in the pavement known as "Reflective Cracks" which is common in an asphalt overlay job.
-
It may interest all to know that we have an Engineers report that states that for the most part, the job meets acceptable standards.
Not perfect mind you - but meets acceptable standards.
-
So, what is this all about; I submit that this is an effort by a handful of Malcontents who can't get over failing in their effort to recall the UCO President, and then failing miserably in the March election.
One might think that they got the message, but apparently not!
-
So, rather than work cooperatively for the benefit of the Village, they run to the Courthouse. These people have done this before, at great financial detriment to the Residents to the tune of $700,000.00 that might have been captured in settlement but rather went into the pockets of Attorneys.
-
This law suit they are cooking up is patently frivolous, and will only make the Attorneys rich. 
-
Most importantly, when they start making motions or begging at our meetings to put their hands into your pocket and mine to fund their unconstrained fantasies of financial paradise, don't fall for it, it is a snake oil salesman's  dream.
